Asset Tracing

The Problem

A common mistake made in commercial litigation matters is to assume, when it’s necessary to sue someone or a business, that if your legal case is strong and a settlement is reached or court judgment handed down in your favour, you will then receive the agreed or ordered damages. In many cases that does not happen and it can cost a lot of money in time and legal costs to pursue a case.

Consequently, it is highly important to make appropriate enquiries at the outset to seek to determine whether a debtor is worth suing.

In some cases an opponent, whether in a divorce, fraud or other case, will deliberately hide assets or move them to different jurisdictions or legal entities in a deliberate attempt to conceal those assets. In such circumstances it is essential to act fast and to seek expert advice in tracing assets in conjunction with legal advisors.

The Solution

Whilst clients in difficult situations such as the above need information, it is also vital that any investigations undertaken are legally compliant. Any breach of the law in asset based enquiries is a severe breach of data protection and other laws, potentially creating criminal as well as civil liability. We consider it important to make it clear that our enquiries are entirely lawful and we do not promise what we can’t deliver.

Fundamentally, there is no 100% guarantee that any form of legal asset tracing will deliver information or results. However, skilled and experienced investigators can often obtain very useful information and our commitment is to thoroughly investigate, within the law, in a proportionate and cost effective way, and to provide a report of our activities and findings.

We can assist in investigating :-

  • UK Property assets
  • Corporate assets and connections
  • Related party transactions and assets hidden by ownership by connected individuals, companies or corporate entities
  • Offshore assets & property
  • Directorships

We regularly work with law firms, insolvency practitioners and private clients on complex asset tracing enquiries, and are known for adopting a commercial, cost/benefit approach.
